HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.43207 OF 2017 ORDER:

This Writ Petition is filed seeking writ of mandamus declaring the action of the respondents in levying Goods and Services Tax (GST) on the license fee payable by the petitioner for the licenses granted in their favour to carry on their respective businesses, trade and vocation in violation of the terms of license granted in favour of the petitioners, as illegal and arbitrary.

Heard learned counsel for the petitioners and Sri B.Mayur Reddy, learned Standing Counsel for respondents 1 to 5. It is not mentioned in the affidavit filed in support of the writ petition about what is the common cause of action amongst petitioners. Even when the same is pointed out to the learned counsel for the petitioners, he is also not in a position to state what is the common cause of action involved amongst petitioners. Since there is no common cause of action amongst petitioners, I am not inclined to entertain the Writ Petition and accordingly the same is dismissed. However, it is open for the petitioners to institute separate writ petitions in respect of their individual cause of actions, if they are so advised.

There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand dismissed.
