THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.44129 of 2017 ORDER:
This writ petition is filed seeking to declare the action of respondents 1 to 3 in interfering with the possession and enjoyment of the petitioner over the land admeasuring Ac.1.48 cents situated in Survey No.16/2 of Ozubanda Village, Gangavaram Mandal, East Godavari District, at the instance respondents 4 and 5, as illegal and arbitrary. It is the allegation of the petitioner that the respondents are interfering with her possession and enjoyment over the subject land.
Learned Government Pleader for Revenue appearing for respondents 1 to 3 submits that the petitioner is orally instructed but no proceedings are initiated against her. According to the petitioner also, there are no proceedings initiated.
A perusal of the documents filed along with the writ petition prima facie discloses that the petitioner is the owner and
possessor of the lands in Survey Nos.27/2, 18/4 and 16/2 of Ozubanda Village, Gangavaram Mandal, East Godavari District. In those circumstances, the writ petition is disposed of leaving it open to the petitioner to approach the competent Court or other appropriate forum and seek injunctive reliefs against respondents 4 and 5. It is made clear that the respondent authorities shall not interfere in any manner with the petitioner's possession and enjoyment over the subject land as long as her title is valid and subsisting, without following due process of law. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
