HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.42617 of 2017 ORDER:
This writ petition is filed seeking verbatim the following relief/s: '...to issue a Writ, Order or Direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents No.3 & 4 in laying the road through the patta land of the petitioners bearing Sy.No.45/U extent Ac.4-38 gts; Sy.No.45/Ee extent Ac.2-04 gts; Sy.No.46/Aa extent Ac.0-35 gts; Sy.No.47/A extent Ac.0-35 gts and Sy.No.48/Aa extent Ac.0-21 gts and Sy.No.45/Aa extent Ac.2-18 gts all situated in the limits of Mukthipad village, Kosigi Mandal, Mahabubnagar District, as illegal, arbitrary, violation of principles of natural justice and contrary to the specific provision contained under Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and consequently direct the Respondents not to dispossess the petitioners by laying the road through their patta lands, without following due process of law, and pass such other order or orders....
Learned counsel for the petitioners would submit that the respondent authorities are making efforts to lay road from the subject lands of the petitioners without following due process of law and that if a direction is given to the respondents not to interfere with the lands of the petitioners except by following the procedure established by law, the ends of justice would be met. Learned Government Pleader representing the respondents endorses the said submissions.
In the light of the submissions made by the learned counsel, the Writ Petition is disposed of directing the respondents not to interfere with the respective possessions of the petitioners over the subject lands, without following the procedure established by law.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
