Heard learned counsel for the petitioner and learned Standing Counsel for respondent No.3.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondent No.3 in taking steps to demolish the illegal constructions made by the unofficial respondents in the premises bearing H.Nos.6-6-21/ 1 and 6-6-21/ 1/ A, situated at Kasba, Nirmal District, as illegal and arbitrary.
When the matter is taken up for hearing, learned Standing Counsel would submit that permission was granted for ground +1st floor and when it was brought to their notice that the unofficial respondents are proceedings with construction of second floor, a notice under Section 228(1) and (2) of the Telangana Municipality Act (for short, 'the Act') came to be issued on 05.12.2018, giving seven days time and the second notice under Section 228(3) of the Act is also given to the unofficial respondents. Since no reply is given to the said notices though more than a week is lapsed, the authorities are taking steps for removal of the said construction, in accordance with law.
Since the grievance of the petitioner has been addressed to by taking necessary action, nothing survives for adjudication in the
present writ petition and the same is accordingly closed. No order as to costs.
Pending miscellaneous petitions shall stand closed in the light of this final order.
