THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 44167 OF 2017 O R D E R:

It is the case of the petitioner that a third party has occupied the Government land to an extent of Ac.1.34 guntas in Survey No.107 of Mahabubabad Village and Mandal, Mahabubabad (Warangal) District, worth about Rs.100 crores. Having perused the cause title and the nature of relief sought in the writ petition, this Court finds that the third party, who occupied the Government land, has not been made party respondent and the writ petition filed in the present form, does not satisfy the requirement of the Public Interest Litigation, as notified by this Court. When the same is pointed out, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to the petitioner to file a fresh writ petition in the format as mandated.

Permission is accorded and the writ petition is dismissed as withdrawn with liberty as prayed for.

Consequently, the miscellaneous petitions, if any shall stand closed. No costs.
