THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.41169 of 2017 ORDER:

In this writ petition, the grievance of the writ petitioner is against the action of the respondents 1 to 5 in continuing the 7th respondent as the member of the 6th respondent Society despite an enquiry report received against him for various irregularities and illegalities and a representation made by the petitioner, on 16.08.2017, for taking appropriate action for discontinuation of the 7th respondent as the member of the 6th respondent Society.

At the hearing, learned counsel for the petitioner submits that if a direction is given to the 4th respondent to consider and dispose of the aforesaid representation of the petitioner, the ends of justice would be met and the grievance of the petitioner would stand redressed. Learned Government Pleader for Fisheries, appearing for the respondents 1 to 5, would submit as follows: - 'The 7th respondent, who is having a primary membership in the 6th respondent Society, cannot be removed without following the procedure established by law. Therefore, an enquiry was caused; enquiry report has been received. The said report has to be placed before the General Body of the Society and after following the procedure established by law, appropriate decision would be taken in the matter.' Recording the afore-stated submissions, the Writ Petition is disposed of directing the respondents to follow the procedure established by law and take an appropriate decision on the removal of the 7th respondent from the 6th respondent Society, within a period of eight (08) weeks from the date of receipt

of a copy of this order. However, it is made clear that while taking the decision, the representation of the petitioner, dated 16.08.2017, shall be duly considered.

There shall be no order as to costs.
