Rai Chandra Shekar v. The State Of Telangana,

2017-12-22A Ramalingeswara Rao2 pages

THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.43818 of 2017 ORDER:

This Writ Petition is filed challenging the appointment of the sixth respondent consequent to the death of one Hanumanthu, who was working as Village Revenue Assistant of Singireddypalem, on 20.01.2016. Though the petitioners are not related to the said Hanumanthu, the grievance of the petitioners is that none of the family members of Hanumanthu are entitled for appointment as Village Revenue Assistant and if a notification is issued, they will have a chance to apply for the same. In those circumstances, they challenged the order dated 13.09.2017 appointing the sixth respondent as Village Revenue Assistant on compassionate grounds.

Since there is a provision for appeal, this Court is not inclined to entertain the present Writ Petition, but gives liberty to the petitioners to challenge the impugned order dated 13.09.2017 before the appropriate appellate authority within a period of fifteen days from the date of receipt of a copy of this order. As and when the appeal is filed, the appellate authority shall consider the same and pass appropriate orders after hearing the sixth respondent, within a period of eight weeks from the date of receipt of the appeal.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 22.12.2017 Note: Issue C.C in three days.
