THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.40600 of 2017 ORDER:

The only grievance of the petitioners is that Roads & Buildings Department is attempting to interfere with/ demolish the subject property of the petitioners and trying to dispossess the petitioners from the subject property on the ground that the property is required for road widening. It is also the case of the petitioners that such attempts are being made without following the procedure established by law and without paying compensation by acquiring the required portion of the subjec t property of the petitioners. At the hearing, learned counsel for the petitioners would submit that if the writ petition is disposed of directing the respondents not to interfere with or demolish any part of the subject property of the petitioners without following due process of law and without acquiring the property of the petitioners and paying compensation to which they are entitled to, the ends of justice would be met.

Learned standing counsel representing the 5th respondent would submit that the road widening is being undertaken by the R & B Department.

Learned Government Pleader for Roads & Buildings representing the respondents 2 to 4 endorses the submissions of the learned counsel for the petitioners.

Recording the afore-said submissions, the Writ Petition is disposed of directing the respondents not to interfere with or demolish any part of the subject property of the petitioners except by following due process of law and without paying any compensation to which they are entitled to after acquisition of the property in accordance with the procedure established by law. There shall be no order as to costs.
