THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.43355 of 2017 ORDER:

The petitioner was appointed as Reserved Constable in D.A.R. Ranga Reddy District, and put in service of 18 years. It appears that while he was undergoing Escort Duty on 13.09.1996 along with four (04) Head Constables and eleven (11) Police Constables to receive 28 Under Trial Prisoners to produce them before Judicial Magistrate of First Class Court and take them back to Central Prison, Hyderabad, one prisoner escaped from the hands of police. In that connection, Crime No.486 of 1996 was registered against the petitioner for the offence punishable under Section 224 IPC at Saroornagar Police Station. 2.

Initially, the petitioner was placed under suspension on 19.09.1996 and charges were framed against him on 01.10.1996. An enquiry was conducted, which ultimately led to dismissal of the petitioner from service on 01.09.1997 on the ground that he was negligent in discharging his duties. Challenging the same, the petitioner filed O.A.No.2784 of 1998 before the Andhra Pradesh Administrative Tribunal and the same was dismissed on 29.01.2003. Against the said order, he filed W.P.No.16648 of 2006 and the same was admitted on 09.08.2008. After admission, it appears that on the advice of some one, he withdrew the writ petition and accordingly, the Writ Petition was dismissed as withdrawn on 23.01.2005. Without taking any steps for revival of the said writ petition, he filed the present Writ Petition challenging the order, dated 01.09.1997, dismissing him from service.

Since Writ Petition No.16648 of 2006, which was filed before the Division Bench against the order in O.A.No.2784 of 1998, dated 29.01.2003, was withdrawn by the petitioner on his own, this writ petition cannot be entertained and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
