HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 5 7 5 2 of 2 0 1 8 ORDER: - Heard learned Counsel for the petitioner and the learned Government Pleader for the respondents.
The District Collector/ R.2 herein by way of an Order vide proceedings No.Rc.C4.371/ M/ 2011, dated 14.03.2014, cancelled the Caste Certificate of the petitioner herein. As against the said Order, the petitioner herein claims to have filed a statutory appeal under Section 7(2) of the Act 16 of 1993 on 27.05.2014. The grievance of the petitioner in the present Writ Petition is despite lapse of considerable length of time, no action so far has been taken by the 1st respondent in the direction of disposing of the statutory appeal preferred by him and in view of the same, the petitioner herein is sustaining irreparable loss and hardship. Since the petitioner herein presented the appeal as long back as on 27.05.2014 and as the State Government also called for remarks from the District Collector by way of Memo bearing No.6435/ CV.
1/ 2014, dated 05.08.2014, this Court finds no justification on the part of the 1st respondent herein in keeping the appeal filed by the petitioner pending all these years. For the aforesaid reasons, the Writ Petition is disposed of, directing the 1st respondent herein to pass appropriate Orders on the appeal, dated 27.05.2014, preferred by the petitioner herein against the Order of the District Collector/ R.2 herein, dated 14.03.
