HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 40437 of 2017 Order:

The petitioner was appointed as a Driver of Banswada Depot on 15.05.2006. It appears that while driving the Bus bearing registration No.AP 29 Z 2259 on 08.09.2017 on route JBS - Banswada, he caused an accident resulting in death of three persons. In that connection, the respondents wanted to conduct an enquiry and kept the petitioner under suspension by proceedings dated 13.09.2017. Now the enquiry is under progress. At this stage, the present Writ Petition is filed challenging the order of suspension dated 13.09.2017.

Since the enquiry is under progress, this Court is not inclined to entertain the Writ Petition challenging the order of suspension, but directs the third respondent to complete the enquiry as expeditiously as possible, but not later than two (2) months from the date of receipt of a copy of this order, as the enquiry was commenced way back on 13.09.2017. It is needless to observe that while conducting enquiry the Enquiry Officer shall follow due process of law.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
