THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITIONS No. 45714, 45715, 45718, 45751 AND 45774 OF 2018 COMMON ORDER :

Heard learned counsel for the petitioners, Sri R.Vinod Reddy, learned Standing Counsel appearing for respondent Nos.1 to 3 and Sri Sampath Prabhakar Reddy, learned Standing Counsel for the 4th respondent.

The grievance of the petitioners in all these Writ Petitions is that the respondents are not releasing the power supply to their premises on the ground that they had not produced Occupancy Certificate.

Across the Bar, it is submitted that by Order dated 13.02.2017 in W.P.M.P.No.3057 of 2017 in W.P. No.2608 of 2017, this Court directed the respondents therein to release the power supply to the building of the petitioner therein subject to the compliance of terms and conditions of supply and that the same can be withdrawn if an occupancy certificate is not obtained later from the municipal authorities.

In view of the above, these Writ Petitions are also disposed of with a direction to the respondents to release the power supply to the premises of the petitioners, subject to their complying with the terms and conditions of supply and also on furnishing an undertaking to produce the occupancy certificate from the Municipality/Municipal Corporation concerned within a period of three months, and if no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action in accordance with law. No order as to costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
