THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Criminal Petition No.12375 of 2017 ORDER:

The present Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code') to quash the proceedings in Crime No.161 of 2017 of Banjara Hills P.S., Hyderabad, registered for the offences punishable under Section 3 (1) (x) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 2015 and Section 506 of Indian Penal Code, against the petitioner-accused.

Sri Mahesh Raje, learned counsel for the petitioner, after arguing the matter for sometime, requested this Court to direct the police concerned to follow the procedure under Section 41-A of Cr.P.C.

Acceding to the request of the learned counsel for the petitioners, without touching the merits of the case, the Criminal Petition is disposed of directing the police concerned to follow the procedure under Section 41-A of Cr.P.C. and the guidelines issued by the Hon'ble Apex Court in Arnesh Kumar v. State of Bihar1. As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition shall stand closed.
