HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.44018 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in issuing the impugned notice dated R/B/816/2017 dated 27-11-2017 and handing over the same to the other dealer for distribution is bad in law and illegal and consequently direct the respondents to continue the petitioner to distribute the Essential Commodities to the card holders of Fair Price Shop No.1323039 of Chinnaharivanam Village, Adoni Mandalam, Kurnool District, in the interest of justice." 2.

It is the submission of the learned counsel for the petitioner that the Tahsildar, Adoni, Kurnool District - 4th respondent herein has no jurisdiction to cancel the fair price shop authorization of the petitioner and the same is not disputed by Assistant Government Pleader for Civil Supplies. 3.

In view of the same, the present writ petition is allowed, setting aside the impugned order of the 4th respondent. However, this order will not prevent the competent authority to take any action against the petitioner in case of any violation.
