HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE M.S.K. JAISWAL W.P. No. 43007 of 2017 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed in the nature of writ of habeas corpus seeking direction to respondent Nos.2 and 3 to produce the petitioner's husband i.e. Degapati Maheedhar, before this Court from illegal detention of respondent Nos.4 and 5 and set him at liberty.
The learned Additional Advocate General appearing on behalf of respondent Nos.1 to 3 submits that the official respondents, while investigating Crime No.683 of 2017, which was registered at Gachibowli Police Station on 12.12.2017 for the offence falling under " Man Missing" , traced the missing man D. Maheedhar and recorded his statement. He submits that due to some matrimonial dispute with the petitioner - wife, he is staying with his parents out of his will and wish. There is no illegal detention whatsoever.
Keeping in view the statement made by the learned Additional Advocate General and since there is a matrimonial dispute between the petitioner and the detenu, we are not inclined to pass any further orders in this petition. Accordingly, this petition is closed as no further orders are necessary. No order as to costs.
