THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.39995 of 2017 ORDER:

The complaint in this writ petition is that the respondents are proceeding to demolish the properties of the petitioner, inter alia, alleging that the petitioner erected structures on a nala and that the said structures are obstructing the flow of rain water and that due to such structures large scale inundation of parts of Hyderabad City has occasioned in the rec ent past when there were heavy rains and that the impugned notice is issued directing to vacate and remove the structures within 24 hours from the date of receipt of the notice and that as there is immediate threat of demolition of the structures of the petitioner, which are in existence since a long time, the present writ petition is filed.

At the hearing, learned counsel for the petitioner and the learned standing counsel representing the respondents 2 & 3 would submit that the issue in the present writ petition is squarely covered by interim order, dated 30.09.2016, of this Court in WPMP.No.42127 of 2016 and batch in WP.No.34149 of 2016 and batch and that this writ petition can be disposed of on the same lines by making the afore-stated interim order as the final order in the present writ petition.

Having regard to the facts and submissions and for reasons alike as were mentioned in the afore-stated interim order of this Court, this writ petition is disposed of in terms of the said interim

order, however, by making the said interim order the final order in this writ petition.

Office is directed to enclose a copy of the interim order, dated 30.09.2016, passed in WPMP.No.42127 of 2016 and batch in WP.No.34149 of 2016 and batch to this order. There shall be no order as to costs.

There shall be no order as to costs.
