The grievance of the petitioner is that the land belonging to the petitioner temple to an extent of 439.80 square meters was acquired and that the claim of the petitioner for payment of compensation was rejected on the ground that the said property is registered in the name of 'Singareni Collieries Company'. Though, petitioner is having acquired rights in the subject land by virtue of oral gift and also by virtue of court decree in OS.No.18/2013, the competent authority-2nd respondent rejected the claim of the petitioner. Aggrieved by the impugned Award passed by the 2nd respondent vide Award No.01/2007 in RC No.G2364/2012, dated 30.09.2017, present writ petition is filed.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Land Acquisition submits that in case of dispute regarding entitlement, it is open for the petitioner to make application under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short ' The Act'). It is to be seen that as the petitioner has alternative remedy under Section 64 of the Act, it is open for the
petitioner to make application under Section 64 of the Act and the competent authority is directed to consider the same and take action in terms of Section 64 of the Act, within a period of four weeks from the date of receiving application from the petitioner.
With the above direction, the writ petition is disposed of. No order as to costs.
