HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.45844 of 2018 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioners, seeking for a writ of Mandamus to declare the action of respondents in insisting the petitioners to vacate from their respective house site properties bearing Plot Nos.1290, 1324 and 1382, admeasuring 48 square yards each, covered by Survey No.334, situated at Mallayapalem Village of Gudivada Mandal, in Krishna District, assigned in favour of the petitioners, without following the due procedure established by law, as illegal, arbitrary and violative of Standing Orders 15 and 21 of Andhra Pradesh Board of Revenue Standing Orders and offences Articles 14 and 21 of the Constitution of India and for a consequential direction to the respondents not to interfere in any manner with the petitioners' possession over their said house site properties.

Heard Sri Akurathi Ramakrishna, learned counsel appearing for the petitioners and learned Assistant Government Pleader for Revenue (A.P.) appearing for the respondents 1 to 3, and Sri Nimmagadda Venkateswarlu, learned Standing Counsel appearing for the 4th respondent.

Learned Assistant Government Pleader for Revenue submits that the respondent authorities would follow due procedure in case they take action against the petitioners.

In view of the above, the Writ Petition is disposed of directing the respondents not to evict the petitioners from the subject lands, without following due process of law.
ARR, J W.P.No.45844 of 2018 As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
There shall be no order as to costs.
