Chimakurthi Satish Kumar , v. The State Of Andhra Pradesh,
HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.40091 OF 2017 O R D E R :
This writ petition is filed challenging the inaction of the respondent No.2 in releasing the stocks seized in Crime No.53/2017 inspite of the readiness of the petitioner to furnish surety in respect of the same.
Learned counsel for the petitioner submits that on mere suspicion the stocks belonging to the petitioner were seized though petitioner is having valid documents for doing business in rice.
Though petitioner approached 2nd respondent for release of the seized stocks, the same was not considered.
Learned Assistant Government Pleader for Civil Supplies submits that petitioner has to approach the 2nd respondent and submit necessary application in respect of his grievance.
Learned Counsel for the petitioner submits that the petitioner will make necessary application for release of the stocks to the 2nd respondent.
In view of the above, it is open for the petitioner to submit necessary application to the 2nd respondent for release of the stocks by stating above facts, within a period of two weeks from today, and on such application being made, the
2nd respondent is directed to dispose of the same within four weeks there after. Till application of the petitioner disposed of, the seized stocks shall not be sold.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 04.12.2017 Note: Issue CC in three days.
