THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.43301 OF 2017 ORDER:

Heard learned counsel for petitioner and the Assistant Government Pleader for Social Welfare.

The petitioner on 07.07.2017 applied for community and date of birth certificate and the same is acknowledged under receipt No.AA3427781- Ex-P1.

Now, the grievance of petitioner is that the respondent No.3 is not taking up the application, affording opportunity to petitioner and deciding the request in accordance with law. The prayer is substantially against inaction of respondent No.3 in enquiring into and passing orders on application dated 07.07.2017.

I am satisfied, the writ petition can be disposed of by this order:

(a) The petitioner is given liberty to re-submit the Xerox copy of receipt together with the application form and copy of this order within four (04) weeks from today. (b) The 3rd respondent considers the issue and disposes of the application in accordance with law, if necessary, by providing opportunity to petitioner as well within two (02) months from the date of receipt of copy of this order.

No order as to costs.
