There are no grounds to transfer including from what the trial Court stated not permitted PW.1's cross-examination under the guise of the discharge of the debt, burden is on the defendants, though same is irregular and once PW.1 come to the witness box, the right of the cross-examination is available to the defendants and it is only left open to PW.1 if at all there is any issues to be reserved for rebuttal and so long as such option has party did not exercise, burden of proof when pales significance. Thereby, the trial Court shall permit PW.1's cross-examination by the defendants and proceed further with the matter, as early as possible, since already identified matters of 2010. 3.

Accordingly and with the above direction, all transfer C.M.Ps. are disposed of.
