THE HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.46551 OF 2018

O R D E R

The grievance of the petitioner is with the action of the authorities in including his land admeasuring Ac.1.39 guntas in Survey No.141 of Tandur Village, Tandur Mandal, Vikarabad District, in the List of Wakf properties. The petitioner made representations dated 09.03.2016, 20.04.2016 and 24.10.2016 to the revenue authorities in this regard stating that the land in question is a patta land and was not notified as Wakf land. He requested the revenue authorities to look into the matter and ensure that the inclusion of the land in Survey No.141, Tandur Village, Tandur Mandal, Vikarabad District, was nullified by deletion thereof from the List of Wakf properties. It is relevant to note that the last of the representations, being the one dated 24.10.2016, was made to the Collector, Vikarabad District.

As the revenue authorities are yet to act upon the petitioner's representation, this Court sees no reason to entertain this writ petition for adjudication on merits.

Sri M.A.Mujeeb, learned counsel representing the Telangana Wakf Board, also expresses consent to the disposal of the writ petition directing the revenue authorities to look into the matter.

The writ petition is accordingly disposed of directing the District Collector, Vikarabad District, to consider the petitioner's representation dated 24.10.2016 and take appropriate action thereon in accordance with the due procedure. This exercise shall be completed expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
