HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.41373 of 2017 ORDER:
Heard Sri G.Madhusudhan Reddy for petitioner and the Assistant Government Pleader for Home.
The petitioner prays for the following relief :- "..... to issue Writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.2 in interfering into the civil disputes and thereby not allowing the petitioner to enter into the assigned land in survey No. 17/55 extent Ac.03.00 situated at Pulikunta village, Rebbana Mandal, Komurambheem Asifabad District in collusion with the respondents No. 3 to 8 and directing the petitioner to settle the matter with the respondents 3 to 8 as arbitrary and illegal and also contrary to orders passed by this Hon'ble court and also violative of Article 16 and 300A of constitution of India, consequently direct the respondent No.2 not to interfere into the peaceful possession and enjoyment of the agricultural land is Sy No.
17/55 situated at Pulikunta village, Rebbana Mandal, Komurambheem Asifabad District ...." Admittedly, the petitioner has filed W.P.No.36419 of 2017 and this Court has already considered the prayer and granted interim order. Now by referring to subsequent development namely interference by police, the present writ petition is filed. This Court is of the view that the petitioner has to work out all the prayers vis-à-vis the subject matter of writ petition in W.P.No.36419 of 2017.
By granting liberty to the petitioner to file implead petition in W.P.No.36419 of 2017, the writ petition is dismissed accordingly. No order as to costs.
