THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.45903 OF 2018 ORDER:

This Writ Petition is being disposed of at the stage of admission with the consent of both the parties. This Writ Petition is filed with the following prayer:- "...to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents, particularly the fourth respondent, in not considering the candidature of the petitioner for promoting to the post of Woman Assistant Sub-Inspector in Khammam District under Rule of reservation as envisaged under Rules 22 & 22A of the Andhra Pradesh State and Subordinate Service Rules, 1996 and G.O.Ms.No.

2, Social Welfare ROR1, as being arbitrary, illegal and violative of Articles 14 and 16 of the Constitution of India and consequently to hold that the petitioner is entitled to be promoted as Woman Assistant Sub-Inspector of Police (Civil) in Khammam District under Rule of reservation in terms of Rules 22 & 22A of the Andhra Pradesh State and Subordinate Service Rules, 1996." Heard Sri B.Ramulu, learned counsel for the petitioner and the learned Government Pleader for Home for the respondents. It has been contended by the petitioner that the petitioner belongs to Scheduled Tribe Community and has been working as Woman Head Constable.

The petitioner further contended that she is fully eligible and qualified to be promoted as Woman Assistant Sub-Inspector of Police and the State Government has taken a policy decision to extend reservation even in the matters of promotion. But the respondents are not considering the case of the petitioner for promotion by extending the Rule of reservation.

21.12.2017 requesting the respondents to consider her case to the post of Woman Assistant Sub-Inspector of Police. The petitioner contends that the respondents are not considering the case of the petitioner nor passing any orders on the representation submitted by her. Counsel for petitioner further contends that appropriate orders be passed in the Writ Petition directing the respondents to consider the representation submitted by the petitioner on 21.12.2017 and pass appropriate orders in accordance with law. Learned Government Pleader appearing for the respondents submits that the representation submitted by the petitioner will be considered and appropriate orders will be passed in accordance with law.

This Court, having considered the rival submissions of the parties, is of the considered view that this Writ Petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 21.12.2017 and pass appropriate orders in accordance with law within a period of four

(4) weeks from the date of receipt of a copy of this order. With these observations, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
