THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case No.2708 of 2017 ORDER:

This Contempt Case is filed alleging violation of orders dated 25.04.2017 passed by this Court in W.P.M.P.No.14140 of 2017 in W.P.No.11380 of 2017.

By the above said order, this Court directed respondent Nos.2 and 3 therein to inspect the open areas, demarcated in the approved plan, and ensure that the open areas are left without there being any construction; no constructions whatsoever are permitted; and if any constructions are there, they shall remove the same. Counter affidavit has been filed by respondent No.1 stating that respondent - Corporation issued show cause notice dated 03.02.2018 to Sri Chanduri Ramaiah (writ petitioner in W.P.No.10682 of 2018). The said writ petitioner submitted a reply to the said show cause notice; thereafter vide notice dated 21.03.

2018, the respondent - Corporation has cancelled the LRS approval granted to Chunduri Ramaiah and 3 others represented by DAGA holder M/s Avanthika Homes; aggrieved thereby the said Chunduri Ramaiah and 3 others represented by DAGA holder M/s Avanthika Homes approached the Court by filing W.P.No. 10682 of 2018; vide order dated 06.04.2018, passed in I.A.Nos. 1 and 2 of 2018 in W.P.No.10682 of 2018, this Court granted interim suspension of the notice dated 21.03.

disposal of the said writ petition they would remove all encroachments in the public place or public park strictly in accordance with law. In view of above submission, this Court is of the considered view that the contempt case may be closed. However, it is left open to the petitioner to file a fresh application seeking revival of the contempt case in accordance with law, in case the cause in the contempt case survives.

Miscellaneous petitions, if any pending in this contempt case shall stand closed.
