THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11752 OF 2017 ORDER:

Heard learned counsel for the petitioner/A.4, learned Additional Public Prosecutor for the respondent State and perused the record.

This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioner/A.4 in S.C.No.113 of 2017 on the file of I Additional District and Sessions Judge, Rajamahendravaram, East Godavari District.

The material on record reveals that 40 kgs of ganja containing in two gunny bags was seized from the possession of the petitioner/A.4, when he along with other accused was travelling in Tata Indica car bearing No.AP9 BC 2169 on 10.01.2017. The earlier bail application of the petitioner was dismissed by this Court vide order dated 05.06.2017 in Crl.P.No.3491 of 2017, wherein it was held that there is a prima facie case against the petitioner. In the circumstances, no different view can be taken.
