This petition is filed seeking for relaxation of the condition imposed by the III Additional Metropolitan Sessions Judge, Hyderabad, in Crl.M.P.No.2872 of 2017, dated 23.09.2017. 2.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

By the impugned order, the III Additional Metropolitan Sessions Judge, while granting anticipatory bail, imposed certain conditions, including that of surrender of passport of the petitioner.

Now, the counsel for the petitioner submits that the petitioner is working in Dubai and he is at present residing in Dubai only and that a look out notice was issued and in view of the condition of surrendering of passport, petitioner is not able to come to India.

Considering the above submission and also in order to secure the presence of the petitioner, this court deems it appropriate to relax the condition of surrendering of passport of the petitioner, imposed by the III Additional Metropolitan Sessions Judge, Hyderabad, in Crl.M.P.No.2872 of 2017, dated 11.12.2017, and substitute the same with a condition of depositing a sum of Rs.1,00,000/ - (Rupees one lakh only), before the court of the learned III Additional Metropolitan

Sessions Judge, Hyderabad, within one month from the date of this order. The said amount shall be forfeited in favour of the de facto complainant if there is any default of appearance of the petitioner, when directed by the court.

With the above observations, the Criminal Petition is allowed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
