Heard learned counsel for the petitioner and learned Standing Counsel for respondent Nos.2 to 4. With their consent, the writ petition is disposed of at the admission stage. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents to demolish the building structures constructed by the petitioner in H.No.45/ 23, situated in Ashok Nagar, Kurnool town for acquiring house site structures for formation of drainage canal, as illegal and arbitrary.
Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents not to demolish the construction made by the petitioner in respect of the above property, except in accordance with law.
Learned Standing Counsel submits that any action to be taken by the authorities shall only be in accordance with law. Having regard to the above, the writ petition is disposed of directing the respondents not to demolish the construction made by the petitioner in respect of H.No.45/ 23, situated in Ashok Nagar, Kurnool town, without following the procedure established by law. No order as to costs.
Pending miscellaneous petitions shall stand closed in the light of this final order.
