THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.41191 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner to declare the action of the 2nd respondent Municipality in proceeding with the construction of Public Toilets in front of the shopping complex of the petitioner bearing Door No.7-2-53/15, situated at Punjab Chowk, Adilabad, Adilabad District, without following any procedure established by law and without considering the representation, dated 30.11.2017, of the petitioner, as illegal, arbitrary and violative of principles of natural justice. 2.
I have heard the submissions of Sri S. Surender Reddy, learned counsel appearing for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent, and of Sri N. Praveen Kumar, learned Standing Counsel appearing for the 2nd respondent Municipality. I have perused the material record.

At the hearing, learned counsel for the petitioner submits that if a direction is given to the 2nd respondent Municipality to consider and dispose of the said representation of the petitioner, the ends of justice would be met.

Learned Standing Counsel for the 2nd respondent Municipality endorses the said submission.

Having regard to the submissions, the Writ Petition is disposed of directing the 2nd respondent Municipality to consider and dispose of the representation, dated 30.11.2017, of the petitioner within a period of three (03) weeks from the date of receipt of a copy of this
MSRM, J W.P.No.41191 of 2017 order, however, in strict accordance with the procedure established by law and communicate a copy of the decision taken on the representation of the petitioner within a week thereafter to the petitioner.
There shall be no order as to costs.
