THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.45945 of 2018 ORDER:
Challenging the inaction of the respondents on the representation, dated 26.09.2018 of the petitioner, the present Writ Petition is filed.
2) It is the case of the petitioner that in response to the tender notification, dated 28.08.2017, issued by the 2nd respondent, he participated in the said tender with regard to Sangareddy District and he was awarded the Transportation contract for the period 01.10.2017 to 30.09.2018 and the same came to an end by 30.09.2018. Subsequently, though the Corporation had issued a fresh tender notice, however, on 14.09.2018, the petitioner was issued proceedings extending his contract by two more months i.e., upto 30.11.2018 or a new contractor takes up the work for the year 2018-19. However, as the respondents were not able to finalize fresh transportation contract and the petitioner is continued to do the work even after the extended period of contract of two months, and he is working for the 3rd month also.
It is further submitted that the new contract for the subsequent period is going to be awarded at the rate of 29%, over and above the rate at which the petitioner has performed the contract. Therefore, the petitioner submitted his representation dated 26.09.2018 to the Corporation, ventilating his difficulties and requested to increase the rate by 40% for the extended period of contract for smooth functioning of Stage-1 movement for Sangareddy District, but there is no response from the respondents.
17.10.2013, in W.P.No.9509 of 2013 and Batch, pursuant to which the transport charges were enhanced by 15%, by proceedings of the 2nd respondent, dated 21.11.2013. In that context, the petitioner has made a representation, dated 26.09.2018, to the respondents and seeks a direction to the respondent authorities to consider his representation.
3) Heard the learned counsel for the petitioner. The learned Standing Counsel for Civil Supplies Corporation (Telangana) submits that the representation, dated 26.09.2018, of the petitioner would be considered in accordance with law. 4) The innocuous prayer, which the petitioner seeks before the Court, is that the representation filed by him on 26.09.2018, and pending before the 2nd respondent, is to be disposed of as expeditiously as possible.
5) Considering the prayer of the petitioner, without expressing any opinion on merits of the matter, the 2nd respondent is directed to consider the representation, dated 26.09.2018, and pass appropriate orders within six weeks from the date of receipt of a copy of this Order.
6) The Writ Petition is accordingly, disposed of. No costs. 7) Consequently, Miscellaneous Petitions pending, if any, shall also stand closed.
