THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.42760 of 2017 ORDER :

This writ petition is filed challenging the proceedings of the 3rd respondent dated 05.12.2017 whereby the 3rd respondent addressed a letter to the Station House Officer, Chandrugonda Police Station seeking to remove the encroachments from the Road Transport Corporation land Chandrugonda Bus Station.

The petitioner claims title over the subject-land by virtue of Adangals and Pahanies. The learned counsel for the petitioner submits that the respondents, without any authority, are trying to conduct auction of the land pertaining to the petitioner. On the other hand, the learned Standing Counsel for the respondents 1 to 3 submits that it is only a communication by the 3rd respondent to the Station House Officer, Chandrugonda for removal of encroachments and that the respondents are conducting the proposed auction of land in the existing bus station. It is to be seen that if the petitioner has any title over the subject-land, he has to approach the proper civil Court for establishing his title and these disputed questions of fact cannot be decided by this Court in the writ petition. In view of the same, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is dismissed. However, it is open for the petitioner to avail other remedies available to him under law. No costs.

Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
