HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.42594 of 2017 ORDER:

This writ petition is filed seeking verbatim the following relief/s: '...to issue any appropriate writ, order or direction more particularly one in the nature of writ of mandamus directing the Respondents not to make any attempts of laying 100' roads or pipelines through the lands in Sy.No.249 of Garimella Village, Mancherial municipality and Mandal, Mancherial District, contrary to the prevailing Master Plan sanctioned under G.O.Ms.No.320 MA and UD, dt.18-08-2012, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.' Learned counsel for the petitioner submits that the respondents are making attempts to lay 100 feet road and/or pipelines through the lands in Sy.No.249 of Garimella Village of Mancherial municipality contrary to the existing Master Plan sanctioned under G.O.Ms.

No.320 MA and UD, dated 18.08.2012. He would further submit that if a direction is given to the respondents to implement the Master Plan sanctioned vide the afore-stated G.O as regards the 100 feet road, the ends of justice would be met. Learned standing counsel representing the 2nd respondent, on instructions, would submit that only survey was done for laying the 100 feet road and that there is no proposal to change the 100 feet road sanctioned as per the Master Plan and that, if any, deviation is to be made from the Master Plan, necessary procedure would be followed.

Learned counsel for the petitioner, in reply, would submit that the writ petition may be disposed of recording the said submissions.

Accordingly, recording the submissions of the learned standing counsel, the Writ Petition is disposed of directing the respondents not to change the Master Plan with regard to 100 feet road except by following the procedure established by law.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
