The present Writ Petition came to be filed declaring the notice in Cr.No.236/2018/PE/B4, dated 15.09.2018, issued by respondent No.2, directing the petitioner to furnish F.D.R./Bank Guarantee of Rs.85,000/- from any nationalized bank, situated in Talangana State for releasing the vehicle, Bajaj Auto bearing No.TS 25 T 1300, in favour of the petitioner for interim custody, as illegal and arbitrary. 3.
Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking reduction of the F.D.R/Bank Guarantee imposed while releasing the vehicle in Cr.No.236/2018/PE/P4, dated 15.09.2018, from Rs.85,000/- to Rs.50,000/-. The same is opposed by the learned Government Pleaders appearing for respondents. 4.
Having regard to the facts in issue and as the petitioner was not able to get the vehicle released though ordered on 15.09.2018, the Writ Petition is disposed of reducing the F.D.R./Bank Guarantee from Rs.85,000/- to Rs.50,000/- (rupees fifty thousand only), to be furnished by the petitioner
towards granting of obtain interim custody of the vehicle bearing No.TS 25 T 1300. Further, the petitioner shall give an undertaking that she shall not transfer or alienate the vehicle to third party in any manner, shall not encumber or alter the physical features of the vehicle and would produce the same as and when directed before any Court or competent authority, till the criminal proceedings are completed. 5.
