HON'BLE SRI JUSTICE C.PRAVEEN KUMAR W.P. No. 46018 of 2018 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Industries and Commerce (Mines) Department. With the consent of both the parties, the writ petition is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of a writ of mandamus, declaring the action of the respondents in keeping the application of the petitioner for quarry lease of colour granite over an extent of 1-00 Hectare in Survey No.283/ 1 at Asifnagar Village, Karimnagar Mandal and District pending without any reasons, as illegal, improper and incorrect. 3.

Today, when the matter is taken up for hearing, the learned Government Pleader placed on record the written instructions received from the Assistant Director of Mines and Geology, Karimnagar, wherein it is stated that along with the petitioner's application, fourteen other applications were received and the application of the petitioner is fourth, as per priority. It is further stated that a preliminary survey was conducted on 07.07.2018 in respect of the above land, and during the said survey, it was noticed that the applied area of the petitioner is overlapping with other applicants. As some of the applicants had not attended the said survey, inspection could not be completed. According to the

respondents, the next date for survey is fixed on 28.12.2018, which has been communicated to all the applicants, including the petitioner, and as soon as the survey is conducted, the application of the petitioner will be processed and disposed of as per rules. 5.

In view of the instructions received from the Assistant Director of Mines and Geology, stating that the survey of the subject land will be conducted on 28.12.2018 and thereafter, the application of the petitioner will be processed, the writ petition is disposed of at the admission stage, in terms of the same. Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
