HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 46016 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus, declaring the action of the respondents in not considering the applications submitted by the petitioner for change of ownership, renewal of licence and shifting of premises and keeping the matter pending from 2012, as illegal, arbitrary and to direct the respondents to consider and accord permission for renewal of the sawmill licence together with change of ownership and shifting of sawmill premises, if necessary, by granting fresh licence in accordance with law and on the analogy of the orders passed by this Court in W.P.No. 25866 of 2014 and batch, dated 19.09.2018. 2.

At the time when the matter is taken up for hearing, the learned counsel for the petitioner would submit that the State Level Committee is meeting in the first week of January, 2019 and as such, if the applications of the petitioner for renewal of the sawmill licence along with change of ownership and shifting of premises, are forwarded to the said Committee, the Committee will take steps in accordance with law. 3.

The learned Government Pleader for Forests would submit that if the applications of the petitioner are pending consideration, the respondents will forward the same to the State Level Committee within ten days from today, to enable the State Level Committee to consider and pass appropriate orders on the applications of the petitioner, in accordance with law.

Having regard to the facts and circumstances of the case, the writ petition is disposed of at the admission stage, with consent,

directing the respondents to forward the applications of the petitioner to the State Level Committee within ten days from today, in which event, the State Level Committee shall consider and pass appropriate orders on the same, in accordance with law, as early as possible. 5.
