THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.40938 OF 2017 ORDER :

The petitioners, in this writ petition are questioning the action of the respondents in trying to demolish the construction in house Nos.6-67, 6-69, 6-70 and 6-71 in Sy. Nos.136, 139 of Chilkur village, Moinabad mandal, Ranga Reddy District, without following the due process of law as being illegal, arbitrary and for issuance of consequential directions.

The petitioners were issued with notice dated 25-10-2017 by the 3rd respondent requiring them to submit explanation as to the constructions being made allegedly contrary to guidelines detailed in GO Ms.No.111 and the petitioners seems to have submitted detailed explanation on 13-11-2017.

The grievance of the petitioners is that without considering the explanation submitted by them, the 3rd respondent is trying to demolish the structures on the land in question. Hence, the writ petition.

Heard learned counsel for the petitioners and the learned standing counsel for the 3rd respondent-Gram Panchayat. Inasmuch as the petitioners have already submitted detailed explanation dated 13-11-2017, the writ petition is disposed of directing the 3rd respondent to consider the same and pass appropriate orders thereon in accordance with law after affording opportunity of hearing to the petitioners. Till then, status-quo shall be maintained in all respects. There shall be no order as to costs. However, As a sequel thereto, miscellaneous petitions, if any, shall stand closed.
