THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.11597 of 2017 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner/de facto complainant to direct the learned VII Special Magistrate, Erramanzil, Hyderabad, to dispose of Calendar Case.No.4 of 2017 (old C.C.No.17 of 2017) at an early date. 2.

The petitioner herein filed a private compliant under Section 200 Cr.P.C., against the first respondent for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. The said case is coming up for examination of the accused under Section 251 Cr.P.C., but the Court below adjourning the matter from time to time.

The only contention of learned counsel for the petitioner is that on account of delay in disposal of case, the petitioner is put to serious inconvenience and requested the Court to issue a direction to the Court below to decide the aforesaid Calendar Case at an early date.

No doubt, the compliant of the petitioner has to be disposed of within a reasonable time, since early justice is a Fundamental Right guaranteed by the Constitution to the Citizens. However, the Court cannot give undue preference to any case. Therefore, taking into consideration the date of filing of the complaint before the Court, the learned Special Magistrate is directed to dispose of aforesaid Calendar Case, as expeditiously as possible, without giving undue preference to the present complaint lodged by the petitioner.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
