Mohd. Khaja, v. Mr. Ishaq-Ab-Khan,
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 2598 OF 2017 O R D E R:
This contempt case is filed alleging non-implementation of the order, dated 21.03.2017, passed by this Court in W.P.No.4903 of 2017.
By the above said order, this Court issued a direction to the respondent authorities to process the application submitted by the petitioner to grant permission for construction of a slaughter house.
Learned counsel for the respondents submits that initially, certain shortcomings were noticed in the application submitted by the petitioner and the same were made good by him; that so far as his application for building permission is concerned, the Corporation had forwarded the same to the Director, Town and Country Planning and necessary comments/permission are awaited and that the petitioner is required to obtain licence from the competent authority under the provisions of the Prevention of Cruelty to Animals (Slaughter House) Rules, 2001 and also necessary permission from the Pollution Control Board. Learned counsel for the petitioner submits that the petitioner desires to construct the slaughter house in an organised manner and supply meat in a hygienic way and the
same is being thwarted by the respondent authorities for some reason or the other.
It may be noted that the petitioner intends to establish an organised slaughter house, for which he is required to obtain licence in accordance with the law.
In view of the above and as the direction issued by this Court in the aforesaid order is innocuous and simplicitor in nature, the contempt case is closed granting liberty to the petitioner to approach this Court by filing a fresh writ petition in the event of any undue delay on the part of the respondents. Consequently, miscellaneous applications, if any shall stand closed.
