The proceedings of the 2nd respondent in Rc.No.623/2017 dated 10.11.2017 are challenged before this Court on the ground that it was passed without issuing notice to the petitioner, as he came to know the same when he received a notice on 03.12.2018 with respect to filing of W.P.No.43690 of 2018 by the 4th respondent.

Heard Mr. A. Prabhakar Rao, learned counsel for the petitioner, and the learned Government Pleader for Panchayat Raj and Rural Development, State of Telangana.

Learned Standing Counsel fairly submits that the impugned order discloses that the petitioner apparently was not issued a notice prior to passing the impugned order.

Perusal of the order dated 10.11.2017 does not disclose any notice having been issued to the petitioner.

In the circumstances, the impugned order dated 10.11.2017 is set aside, leaving it open to the respondent authorities to issue notice to the petitioner and, after affording opportunity to the petitioner to file his explanation, consider the same and pass appropriate orders. It is needless to mention that if the petitioner desires, he may be given personal hearing. The writ petition is disposed of accordingly. No costs.
