Heard learned counsel for petitioner and learned Government Pleader for Panchayat Raj.

Petitioner claims to be owner of house plot admeasuring 162.66 sq yards in Survey No. 436, 8th ward, Kanigiri Nagara Panchayat, Kanigiri mandal, Prakasam district. This writ petition is filed alleging that even though petitioner submitted application for grant of building permission on 20.4.2018, permission is not granted and same amounts to illegal exercise of power.

Ex.P-1 is representation dated 20.4.2018. It is only a request to the competent authority to grant building permission to construct a house, enclosing a sale deed and encumbrance certificate. Apparently, so far, no building permission application was made as required by the Rules governing the construction of houses in Gram Panchayats or Nagar Panchayats. Thus, even without applying for grant of building permission, petitioner cannot complain inaction, merely because he has submitted a representation. It is also appropriate to note that there is no acknowledgment of receipt of such representation of petitioner dated 20.4.2018. Therefore, the writ petition is liable to be dismissed and accordingly the same is dismissed. However, this order does not come in the way of petitioner submitting appropriate application seeking building permission.
