THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.43130 of 2017 ORDER:
Heard Mr.Prabhakar Sripada, counsel for petitioner and the Assistant Government Pleader (Home) for respondents 1 to 4.
The substance of petitioner's grievance is that the Sub-Inspector of Police, Palakurthy Police station, is interfering in matrimonial dispute and has further compelled the petitioner to execute undertaking dated 10.12.2017 in favour of respondent No.4.
According to Mr.Prabhakar Sripada, any transaction in the presence of police is presumed to be coercive and a by-product of undue influence.
To the pointed query of the Court, whether such extraordinary circumstances are brought to the notice of superiors, he fairly states that having regard to urgency in the matter, he has straight away rushed to this Court by filing the writ petition. Further, he is not reluctant to bring all commissions and omissions of respondent No.4 to the notice of 3rd respondent.
The statement is placed on record.
Writ petition is disposed of as follows:
(a) The petitioner is given liberty to bring all the alleged commissions and omissions of 4th respondent by way of representation and enclosing a copy of this order to 3rd respondent. (b) The 3rd respondent, it is needless to observe, looks into the complaint and takes decision as is warranted. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
