THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.46043 AND 46064 OF 2018 COMMON ORDER The case of the petitioners in both the writ petitions is that they were assigned the subject lands and D form pattas were granted and they are in possession and raised sweet-lime garden. On the complaint of one B.Ram Subba Reddy that the petitioners were not landless poor persons and they obtained the pattas by misrepresentation, 4th respondent - Tahsildar, issued notices and they filed explanations denying the allegation, but the 4th respondent passed orders in Rc.No.658 of 2014 cancelling the pattas granted to them on 11.06.1992. Assailing the order of the 4th respondent, they filed appeals before the 3rd respondent - Revenue Divisional Officer in Rc.A.Nos.393/2018 and 392 of 2018 along with stay petitions.
The grievance of the petitioners is that 3rd respondent has not passed any interim orders and in the meanwhile, based on the instructions of the 4th respondent, the electricity service connections to the subject lands of the petitioners, were disconnected and steps are being taken to evict them. Hence, the writ petitions.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.
Having regard to the facts and circumstances, without expressing any opinion on merits, both the writ petitions are disposed of directing the 3rd respondent - Revenue Divisional Officer, to dispose of the above referred appeals filed by the petitioners in accordance with law, within a period of
four months from the date of receipt of a copy of this order. Till the disposal of the appeals, petitioners shall not be dispossessed from the subject lands. Since it is stated that the electricity service connections were disconnected on the ground of cancellation of pattas, and the appeals are pending, and the petitioners claim that they raised sweet-lime garden in the subject lands, respondents 5 and 6 shall forthwith restore the electricity service connections, which would be subject to the result of the appeals. Interlocutory applications pending, if any, shall stand closed. No costs.
