HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE S.V.BHATT WRIT APPEAL No.1674 OF 2018 JUDGMENT: (Per the Hon'ble Sri Justice S.V.Bhatt) Heard Mr. A. Muqeeth Qureshi for appellant and Mr.Arifullah for respondents.
Mr. Qureshi, after arguing the writ appeal on merits and unable to persuade the court, has made the alternative submission to direct the Enquiry Officer to complete the enquiry pending against the appellant within reasonable time. Learned Standing Counsel does not oppose the alternative prayer. Hence, the following order.
The view taken by the learned Single Judge while disposing of the writ petition substantially requires c onfirmation and accordingly confirmed. However, to meet the ends of justice, the Enquiry Officer is directed to complete the enquiry within four months from today in accordance with law. The appellant shall co-operate with the enquiry officer and shall not take unnecessary adjournments in his completing the enquiry by affording fair and reasonable opportunity.
The Writ Appeal is ordered accordingly. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any pending, stand closed.
