O R D E R

Alleging that the 4th respondent - Society by creating sham documents, allotted plot to the 5th respondent, the petitioner, in this writ petition seeks to take appropriate action against the 4th respondent - Society. The learned Government Pleader for Co-operation submits that it is a dispute between the society and its member and no allegations are made against the official respondents. Therefore, the petitioner has to avail the remedy under Section 61 of the A.P.Co-operative Societies Act, 1974 and writ petition cannot be entertained.

As stated by the learned Government Pleader, the averments in the writ affidavit would show that the dispute is between the members and the society. The allegations of forgery and fraud allegedly committed by the 4th respondent - Society, cannot be gone into by this court in exercise of its jurisdiction under Article 226 of the Constitution of India. Hence, it is open for the petitioner to avail alternative remedies available under law. With the above observation, the writ petition is disposed of. Miscellaneous petitions pending if any, shall stand closed. No order as to costs.
