The criminal petition is filed by the petitioner, under Sections 437 and 439 of Criminal Procedure Code, seeking to enlarge him on bail, in FIR.No.378 of 2017 on the file of Patamata Police Station, Vijayawada. The offence alleged are under Section 8(c) read with 20(b)(ii)(C) of the NDPS Act.

Heard both sides.

The quantity of ganja in this case is 75 Kgs. 4.

The learned Public Prosecutor brings to the notice of this Court that earlier, in CRLP.No.10681 of 2017 dated 13.11.2017, this Court dismissed the bail application filed by the petitioner by considering the merits of the case.

Hence, in such circumstances, when the dismissal was on the basis of merits of the case, this petition cannot be allowed when it is once found that there are no merits of the case. The criminal petition is dismissed.
