THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.NO.46038 OF 2018 O R D E R :

When the matter is taken up, the written instructions furnished by the Inspector of Police, Bhongir Town Police Station, Rachakonda Commissionerate, dated 24.12.2018, are placed on record by the learned Government Pleader. The said instructions read as under:

"One Mr Kaata Innaiah, President of Chaithanya Educational and Social Welfare Society has approached the police of Bhongir Town Police Station and submitted a representation dated 30.10.2018 stating that on the name of their society, there is a land of extent of Ac.4.30 gts covered by Sy.No.760/A beside Eligibith School, Mugdumpalli and in the way to that land there is board on which their banner is there and some unknown drunken people removed that banner, damaged the board, thrown the alcohol bottles where ever they want, due to which, they are facing many problems and hence request3d to identify the people and do justice. Upon receipt of the said complaint, an entry was made into the Station General Diary, after enquiry action will be taken.

A detailed enquiry was conducted. In the enquiry, it is revealed that the subject land belongs to Chaitanya Education and Social Welfare Society is kept idle and it is located at the outskirts of Bhongir Town and Magdumpally road is passing beside this land. Hence, there is a change for the unknown road passers by on the way might be threw liquor bottles and in drunken condition they might be damaged the banner.

Keeping in view of the same, I have issued instructions to the patrolling parties to keep watch on the subject land of the petitioner herein and to apprehend any one and book a case against the concerned persons.

It is pertinent to submit that from the date of the incident i.e. 30.10.2018 police patrolling party are being moved round the clock in that area and are booking nuisance cases on the drunken persons and unsocial elements who are creating nuisance as the land besides public way. Hence, this respondent will look after no such incidents take place in the land of Chaithanya Education and Social Welfare Society outskirts of Bhongir Town limits.

Accordingly, the representation of the petitioner herein has been dispoed of.

To that effect, a notice to the complainant dated 15.12.2018 was also served on the petitioner herein. A copy of the notice dated 15.12.2018 is annexed to this written instructions for the kind perusal of this Hon'ble Court.

It is pertinent to submit that this respondent police has taken action on the representation of the petitioner by patrolling the subject land of the petitioner herein round the clock to avoid any untoward incidents. It is out of place to mention herein that earlier on a complaint of the petitioner herein lodged with the police of Bhongir Town Police Station, a case in Crime No.351 of 2018 under Sections 420, 468 and 471 IPC dated 02.11.2018 was registered against Mr Kaata Innaiah, Ex.President of the petitioner's society as he used society funds illegally for his own by forging the signatures of the

members in respect of land in Sy.No.760/A to an extent of Ac.4.30 gts.

On noticing the written instructions, a request is made by the learned counsel for the petitioner to place on record the said instructions and dispose of the writ petition. Recording the above submission, the writ petition is disposed of by placing the said instructions on record with a further direction to the respondent - police to act in accordance with law. No costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
