HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.41392 of 2017 ORDER:

In this Writ Petition, the submissions and grievance of the petitioner are that in spite of several representations given by him to respondent Nos.2 to 5, the latter are not taking any action against the illegal and unauthorised constructions being made by respondent Nos.6 and 7, without any building permit, in the land in Survey No.96 admeasuring Ac.0.16 guntas situated at Arunodaya Colony, Nagole Revenue Village, Medchal District, which, according to the petitioner, is the Government land.

Learned counsel for the petitioner would submit that the grievance of the petitioner would stand redressed if a direction is given to respondent No.3 to consider and dispose of the representation, dated 09.11.2017, of the petitioner in strict accordance with the procedure established by law. Mr. Pasham Krishna Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation appearing for respondent Nos.2 to 4, on instructions, would submit that an inspection has already been made and that it is noticed that constructions are being made by respondent Nos.6 and 7 in the

aforesaid land, without building permit and that necessary action is already initiated. Learned counsel also endorses the submission of the learned counsel for the petitioner. Recording the aforesaid submissions of the learned counsel, the Writ Petition is disposed of directing respondent No.3 to consider and dispose of the petitioner's representation, dated 09.11.2017, in strict accordance with the procedure established by law within three weeks from the date of receipt of a copy of this order and communicate the decision taken thereto to the petitioner within a week thereafter. While disposing of the said representation of the petitioner, respondent No.3 shall given an opportunity of being heard to the petitioner as well as respondent Nos.6 and 7. It is made clear that till such exercise is completed by respondent No.

3, the respondent-authorities shall stop the illegal and unauthorised constructions being carried on by respondent Nos.6 and 7 in the aforesaid land forthwith by following the procedure established by law. No costs. As a sequel, the Miscellaneous Petitions, if any, pending shall stand dismissed.
