This Writ Petition is filed assailing the action of the respondent No.5 in passing the order by way of impugned notice directing the petitioner to close his fish tank without issuing any notice and without conducting enquiry. It is stated by the learned counsel for the petitioner that in similar circumstances this Court disposed of W.P.Nos.39570 & 39607 of 2017 on 23.11.2017 and same is not disputed by the learned Assistant Government Pleader for Irrigation.

For the reasons alike in the aforesaid order dated 23.11.2017, this writ petition is also disposed of directing the respondent-authorities are directed not to interfere with the activities of the petitioners. But, however, this order will not preclude the competent authorities from taking appropriate action against the petitioners in accordance with law. It is open for the competent authority to take appropriate action as per G.O.Ms.No.7, dated 16.03.2013.

There shall be no order as to costs. As a sequel to the disposal of this Writ Petition, miscellaneous petitions, if any, pending shall stand closed.
