THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.40176 OF 2017 ORDER:

This writ petition was filed by the petitioners, who have been working as Professors on contract basis, after undergoing the selection process in the year 2011 and 2014, pursuant to the recruitment notification issued by the University. The tenure of the contract of the petitioners was being extended from time to time and it is lastly extended up to 03.06.2018.

The 1st petitioner is working as Academic Advisor, whereas the petitioners 2 and 3 are working as Finance and Administrative Advisor and Student Welfare Advisor respectively. When a notification was issued for appointing senior faculty on contract basis, the petitioners filed W.P.No.16069 of 2017 apprehending termination of their services and this Court, by order dated 28.04.2017, directed the University not to finalize the selection process and not to appoint the senior faculty. However, some people were selected and they were designated as guest faculty. The petitioners objected to the same and in that background, the petitioners state that an order was passed on 01.11.2017 declaring that the petitioners would be relieved from the duties after closure of office hours on 30.11.2017.

Challenging the same, the present writ petition was filed and this Court, by order dated 29.11.2017, granted interim suspension for a period of three weeks, while directing the

matter to be posted after two weeks. Now, a counter affidavit is filed along with W.V.M.P.No.5148 of 2017 seeking vacation of the said order.

The learned counsel for the respondent submitted that the averments made in the affidavit filed in support of the writ petition are denied in the counter affidavit and further submitted that after filing the writ petition, a show-cause notice was issued to the petitioners on 12.12.2017 and the petitioners are yet to submit their explanation. 4.

In view of the above said fact, without going into merits of the case, the petitioners are given liberty to submit their explanation to the said show-cause notice, within a period of one week from the date of receipt of copy of the order and after receiving the said explanation from the petitioners, it is open to the respondents 2 to 4 to pass appropriate orders in accordance with law. Till final orders are passed, the petitioners shall be continued in the same position as they are continuing as on today. If any adverse order is passed against the petitioners, the same shall not be implemented for a period of one week. The writ petition is accordingly disposed of.
