THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.41988 OF 2017 ORDER:

In this Writ Petition, the only request of the writ petitioner is to give a direction to the Government to see that the officer, who passed the order impugned in the revision before the Government, may not be a party to adjudication of the revision preferred against the order passed by him.

Learned counsel for the petitioner submits that in the peculiar facts of the case, to meet the ends of justice, a direction may be given to the respondents 1 & 2 to see that the officer, who passed the order under revision before the Government, may not be a party to adjudication of the revision.

Having heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Mines and Geology appearing for the respondents, this Court is of the considered view that the request in the Writ Petition merits consideration. 4.

In the result, the Writ Petition is allowed and accordingly, there shall be a direction to the Government to see that the Officer namely B. Sreedhar, I.A.S., who passed the order, dated 25.04.2017, in Proceedings No.6401/ R3-2/ 2015, in his capacity as Director of Mines and Geology (FAC), Ibrahimpatnam, is not a party to adjudication of the revision filed by the petitioner against the said order. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
